Need an explanation of fair use? Fair use is a mystery – in fact, no one knows how many words of a copyrighted work one can legally copy under fair use.

Let's say you want to use someone else's copyrighted photo in your blog or Instagram post. Is this fair use or copyright infringement? The answer is: it depends on the type and purpose of the use.

Often, determining fair use is a no-brainer. When you write a book review, you must quote from the book in question to comment on it. As a result, you have transformed the original copyrighted work into a new work in your book review.

There are restrictions on how much of a work you can copy for educational purposes. You also cannot use these photocopies as a substitute for required texts. In addition, you cannot charge for the photocopied works (except to recover the cost of photocopying), and you cannot mandate students' use of the copies.

In such cases, fair use seems to be quite simple. You have served the public interest and have not harmed the market for the original work. In fact, book reviews and excerpts often increase sales of the original work by making it known.
